A residence permit (known as ‘leave to enter’ or ‘leave to remain’) is evidence of your legal admittance to the UK to live. How can you transfer your residence permit from an old passport to your new passport in the UK?
Transferring a Residence Permit
The UK Border Agency can transfer a residence permit to a new passport when the old one expires. However, it is not a legal requirement to transfer a residence permit to a new passport.
If you choose not to transfer the residence permit to a new passport, you must carry both passports when you travel to the UK, in order to prove to immigration officers that you have been granted permission to be in the UK legally. But if you do not carry both passports, you may be denied admittance.
Can a Residence Permit Be Transferred at Passport Control?
Passport control cannot transfer your residence permit to your new passport when you re-enter the UK. But, if you can prove that you are entitled to be in the UK, the immigration officer can put a date stamp in your new passport.
Once you return to the UK, you must then send an application to the UK Border Agency asking for a residence permit to be placed in your new passport. Residents must be in the UK when they apply for the transfer of their residence permit.
Which Stamp Do I Need to Apply For?
The type of stamp you apply for will largely depend on your status in the UK. Those who have been granted permanent permission to settle in the UK (Indefinite Leave to Remain) will need to apply for a ‘no time limit’ (NTL) and apply using form NTL. Click here to download form NTL.
Residents who were granted permission to be in the UK for just a limited period of time (Limited Leave to Remain) will need to apply for a ‘transfer of conditions’ (TOC) using form TOC. Click here to download form TOC. Residents who are submitting form TOC will also need to apply for a compulsory biometric residence permit.
Residents are not under any legal obligation to transfer their residence permit to their new passport when it expires, provided they travel with both their old and new passports. However, if you do wish to apply to transfer a residence permit, you will need to apply through the UK Border Agency in the UK, rather than at passport control.
